Terms and Conditions

1.1. These Terms and Conditions apply to all e-commerce services provided within Hungary through the online marketplace found at www.polovarazs.hu (Pólóvarázs) and its subpages (hereinafter: the "Webshop").

1.2. Purchases in the Webshop are made by placing an order electronically, in the manner set out in these Terms and Conditions.

1.3. The Webshop's services may be used by any natural person, legal entity, or other organisation without legal personality, provided they successfully register on the Webshop and accept these Terms and Conditions as binding on themselves.

1.4. The contract between the parties is formed once all mandatory fields of the order form have been completed, the entered data has been reviewed, and the "Order cart contents" button has been confirmed. A contract formed this way — in Hungarian — qualifies as a contract in written form; the Service Provider (Pólóvarázs) files it and retains it for 3 (three) months following its formation.

2.1. Registration takes place under the Login/Registration menu item in the navigation bar, by completing the form found there.

2.2. The Service Provider bears no liability for any shipping delay or other problem or error resulting from data entered incorrectly and/or inaccurately by the Customer. Nor is the Service Provider liable for any damage arising from the Customer forgetting their password or the password becoming accessible to unauthorised persons for any reason not attributable to the Service Provider.

3.1. The essential properties and characteristics of the purchased goods, and instructions for their use, can be found in detail on the relevant product's information page.

3.2. The purchase price is always the gross price indicated under the selected product. The price of the products includes the cost of delivery.

3.3. The Service Provider (Pólóvarázs) reserves the right to change the prices of products orderable from the Website, with any change taking effect as soon as it appears on the Website. A change does not affect the purchase price of products already ordered. If, despite the Service Provider's reasonable care, an incorrect price appears on the Webshop — in particular an obviously erroneous price, e.g. one that differs significantly from the product's well-known, generally accepted or estimated price, or a "0" HUF or "1" HUF price appearing due to a system error — the Service Provider is not obliged to deliver the product at the incorrect price, but may offer delivery at the correct price, upon learning of which the Customer may withdraw from their intention to purchase.

3.4. The Service Provider accepts orders from non-registered Customers as well, provided the Customer fully completes all fields required for the order. The Service Provider bears no liability for any shipping delay or other problem resulting from order data entered incorrectly and/or inaccurately by the Customer.

3.5. By submitting an order, the Customer declares that they accept these Terms and Conditions and acknowledge them as binding.

3.6. Upon receiving the Customer's purchase offer, the Service Provider is required to confirm the purchase to the Customer electronically (by e-mail). If this confirmation does not reach the Customer within 48 hours of the offer being sent, the Service Provider's obligation to fulfil the offer and the Customer's obligation to purchase automatically and unconditionally lapse.

3.7. Mockup creation: At the Customer's request, the Service Provider prepares a mockup (graphic preview) of the product to be ordered. Preparing a mockup qualifies as a separate service. If no order is ultimately placed based on the design shown in the mockup, a fee of HUF 5,000 + VAT per piece is charged for preparing the mockup.

4.1. The Service Provider delivers the product selected and ordered on the Website to the shipping address indicated by the Customer during ordering within 10–12 business days of payment for the order.

4.2. The Service Provider delivers the ordered goods to the address between 8am and 5pm on business days, taking into account any notes provided during ordering.

4.3. The Service Provider fulfils services ordered on the Website at the location stated in the order confirmation sent to the Customer by e-mail.

4.4. Payment options: card payment or bank transfer in advance. Online card payments are processed through SumUp. Card details never reach the merchant. For advance bank transfers, the order is only handed over for delivery once the exact confirmed amount has arrived in our bank account.

4.5. When receiving a product order, the Customer must inspect the package item by item at the time of delivery and, if delivery is complete, sign the receipt of acceptance. After that, the Service Provider is not in a position to accept complaints about missing items. A shipment is only considered undamaged and unopened in its original state if it bears intact security tape. If the Customer notices any damage or discrepancy, the courier must, at the Customer's request, hand over the goods item by item and draw up a report on the spot. Liability for any resulting damage rests with the courier.

4.6. Home delivery fee: for delivery addresses outside Hungary, separate arrangements are required; our colleagues will get in touch after the order is placed.

5.1. Warranty and guarantee are governed by Act IV of 1959 on the Civil Code and Government Decree 151/2003 (IX.22.) on the mandatory guarantee for certain durable consumer goods.

6.1. The Service Provider operates an online platform that allows graphic designs (patterns, illustrations, design elements) to be submitted and products to be sold based on them.

6.2. A person registered as a Designer ("Designer") declares that the graphic material they submit is their own intellectual work and that all copyright in it belongs to them.

6.3. The Designer warrants that the submitted graphic material does not infringe the copyright, trademark, personality, or other rights of any third party, and grants the Service Provider an exclusive, non-transferred right to display it on products.

6.4. The Service Provider acts solely as the operator of the platform and accepts no responsibility for the legal cleanliness, originality, or infringement of third-party rights of submitted graphic content.

6.5. The Designer is entitled to a 10% commission on the net revenue from products sold using their submitted graphic design. The method and frequency of payment are governed by the Service Provider's internal settlement rules.

6.6. The Designer retains copyright in their own work at all times. The Service Provider acquires only a non-exclusive right of use necessary for manufacturing and selling the products.

6.7. The Service Provider is entitled to remove any graphic material reasonably suspected of being infringing or unethical in content.

7.1. Products manufactured to the Customer's custom specifications — in particular a custom graphic, text, size, colour, print, or embroidery — do not qualify as returnable products under applicable Hungarian law, and therefore the right of withdrawal cannot be exercised for them.

7.2. For embroidered products, an order can only be cancelled up until the embroidery program has been prepared but the embroidery process itself has not yet begun. In that case, the Service Provider is entitled to invoice the fee for preparing the embroidery program, as this qualifies as an independently completed service. Once the embroidery process has begun, the order can no longer be cancelled.

7.3. If the Customer wishes to cancel the order after the production process has begun, cancellation is only possible with a 20% handling fee. This handling fee covers the costs of preparing for and beginning production, and payment of it is mandatory.

7.4. By placing an order, the Customer declares that they have read and accept the terms relating to custom production, mockups, embroidery, and cancellation.

8.1. Purchasing on the Website presumes that the Customer is aware of the technical limitations of the internet and accepts the possibility of errors inherent to the technology.

8.2. The Service Provider (Pólóvarázs) is not liable for any damage arising from connecting to the Webshop. The Customer is responsible for protecting their computer and the data stored on it.

8.3. The Service Provider stores data provided by Customers for a specific purpose, solely to fulfil the contract and to later evidence the terms of the contract. The Service Provider does not disclose Customer data to third parties, except where the third party acts as a subcontractor or contributor of the Service Provider in fulfilling the contract. The Service Provider processes data in accordance with Act CXII of 2011.

8.4. The Service Provider (Pólóvarázs) is entitled to amend these Terms and Conditions at any time. Any amendment takes effect as soon as it appears on the Website.

8.5. The contracting parties will make every effort to settle any disputes through negotiation. If this does not lead to a result, the parties — depending on the amount in dispute — stipulate the jurisdiction of the Buda Central District Court.
